Terms & Conditions
Last updated: 7 October 2026. These terms apply to new orders from that date, and to existing customers from 7 November 2026.
1. About these terms
These Terms and Conditions are an agreement between you and Ulrich Wallrodt trading as Tekwizard (ABN 43 006 508 486), 20 Garden Ave, Mullumbimby NSW 2482 (“Tekwizard”, “we”, “us”, “our”). “You” means the person or business ordering or using our services.
By placing an order, ticking the acceptance box at checkout, or continuing to use our services after being notified of these terms, you agree to them.
2. Our services
Tekwizard provides web hosting (server space for websites, email accounts and FTP/cPanel access), domain name registration, SSL certificates and related services. Each hosting plan includes a set amount of storage and a monthly data transfer allowance. Data transfer above your allowance is charged at AUD 6.00 per GB, in blocks of 1 GB.
Support is provided by email, support ticket and phone during normal business hours.
3. Prices and payment
All prices are in Australian dollars (AUD). Tekwizard is not registered for GST. No GST is included in or charged on our prices.
Depending on your plan, you will be invoiced monthly, quarterly, half-yearly or yearly in advance. If you pay by bank transfer, please quote your invoice number.
If an invoice is overdue, we will contact you and give you at least 72 hours to pay or respond. If payment is still not received, we may suspend your services until it is. If you are late paying three consecutive invoices, we may end your services on 30 days’ written notice.
If any other Tekwizard invoice (for example web design or computer repair work) is more than three months overdue, we may suspend or end your hosting services on 30 days’ written notice. This does not affect your right to transfer your domain names, which we will handle in line with the relevant registry rules.
If you are overcharged, we will refund the amount on request, or credit it to your account if you prefer.
4. Renewals, cancellation and refunds
Services renew automatically at the end of each billing period and are invoiced in advance until you cancel. You can cancel at any time by emailing us. Cancellations may take up to 48 hours to take effect, and become final once we confirm them in writing.
We do not refund the unused part of a billing period if you cancel for change of mind. Domain registration and SSL certificate fees are paid to third-party registries and providers and cannot be refunded once processed. This does not limit your rights under the Australian Consumer Law (see section 14).
5. Domain names
Domain names are registered in your name as registrant, subject to the rules of the relevant registry (for .au domains, the auDA Licensing Rules). You must give accurate registrant details, meet any eligibility requirements, and keep your contact details up to date. It is your responsibility to make sure domains are renewed before they expire. We send renewal reminders, but are not responsible for a domain lapsing because an invoice was not paid or your contact details were out of date.
6. Acceptable use
You must use your account for lawful purposes only. You must not use it for, or allow it to be used for:
- hacking, denial-of-service attacks, or unauthorised access to other systems;
- sending spam or unsolicited commercial email (including anything contrary to the Spam Act 2003), viruses or malware;
- hosting or sending illegal material, including illegal pornography;
- running or advertising online gambling;
- using cracked or pirated software, or material that infringes anyone’s copyright or other rights.
We may remove or disable access to material that we find, or that is reported to us (including by the eSafety Commissioner or other authorities), to be unlawful or in breach of these terms. If you breach this section, we may suspend your services and require you to remove the material. If you do not do so within a reasonable time, or the breach is serious, we may end your services.
7. Security and suspension
You are responsible for keeping your passwords secure. Passwords for our services must be at least 10 characters long and contain upper-case letters, lower-case letters and numbers. Special characters are recommended.
If your account or website is compromised, sends spam, hosts malware, uses excessive server resources, or otherwise puts our servers or other customers at risk, we may suspend it immediately, without prior notice, until the problem is fixed. We will tell you as soon as practicable when we do this.
8. Website updates and maintenance
Our hosting service covers the server, network and hosting software only. Unless you have a separate written maintenance agreement with us, you are solely responsible for maintaining your website and its content. This includes updating your content management system (such as WordPress or Joomla), themes, plugins and scripts, applying security patches, and fixing compatibility problems. Compatibility problems include those caused by server software upgrades, such as new PHP versions, which we will announce in advance where reasonably possible.
We are not liable for any loss, downtime, data loss or security breach caused by outdated, insecure or poorly maintained website software. Any work we do to clean, repair or restore a website will be charged at our standard hourly rate unless agreed otherwise.
9. Fair use of server resources
Our servers are shared. Each account has limits on CPU, memory, processes and outgoing email. We may limit, throttle or suspend an account that exceeds these limits or affects the performance of the server for other customers. Where practical, we will contact you first and discuss options such as upgrading your plan.
10. Backups
We back up hosted data nightly and keep each backup for 16 days, as a disaster-recovery measure on a best-effort basis. We do not guarantee that any backup will be complete, current or restorable. Restoring a backup is offered as a courtesy and may involve a fee if the data loss was caused by your own actions (for example deleted files or a compromised account).
You are responsible for keeping your own up-to-date copies of your website, email and data in a separate location.
11. Service availability
We aim to keep our services running continuously, but cannot guarantee uninterrupted or error-free service. Scheduled maintenance will be announced in advance where reasonably possible. If there is an unplanned outage, we will work to restore services as soon as possible. If an outage caused by us lasts more than 24 hours in a month, you may request a pro-rata credit for that period within 30 days.
12. Your content and data
You keep ownership of all content and data you store with us. You give us permission to store, copy (including in backups) and transmit it only as needed to provide our services.
When your services end, you should download any data you need beforehand. We may delete your account data 14 days after the services end. Remaining backup copies expire automatically within 16 days after that.
13. Privacy
We do not sell your personal information. We share it only as needed to provide our services (for example with domain registries, SSL certificate providers and payment processors) or where required by law. Information you submit through our website and client area is sent over an encrypted (SSL/TLS) connection. Our servers are located in Australia. For more details, see our Privacy Policy.
14. Australian Consumer Law and limitation of liability
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot be excluded.
To the extent permitted by law, and where our services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having them supplied again.
Subject to the paragraphs above, and to the extent permitted by law:
- we are not liable for any indirect or consequential loss, including loss of profits, revenue, business, data or goodwill; and
- our total liability to you in connection with these terms or our services is limited to the total fees you paid us in the 12 months before the event giving rise to the claim.
All other warranties and conditions not set out in these terms are excluded to the extent permitted by law.
15. Indemnity
You agree to indemnify us against any claims, losses and costs (including reasonable legal costs) arising from third-party claims, to the extent they are caused by your breach of these terms, your negligence, or unlawful content or activity on your account.
16. Changes to these terms
We may change these terms by giving you at least 30 days’ notice by email. If you do not accept a change, you may cancel the affected services before it takes effect and receive a pro-rata refund of any fees you have prepaid for the period after the change. Prices for prepaid periods will not change during that period.
17. General
- Events outside our control: We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, power or network failures of third-party providers, or cyber attacks, but we will do what we reasonably can to minimise their impact.
- Notices: We may send notices to the email address in your client account. You may send notices to hostingadmin@tekwizard.net.
- Severability: If any part of these terms is invalid or unenforceable, it will be read down or removed to the minimum extent necessary, and the rest of these terms will continue to apply.
- Entire agreement: These terms, together with your order and any separate written agreement with us, are the entire agreement between us about our hosting and domain services.
- Assignment: You may not transfer your account to someone else without our written consent. We may transfer our rights and obligations to a business that takes over our services, with notice to you.
- Disputes: If a dispute arises, please contact us first so we can try to resolve it informally.
- Governing law: These terms are governed by the laws of New South Wales, Australia, and both parties submit to the jurisdiction of the courts of New South Wales.
18. Website copyright
The content of the tekwizard.net website is copyright of Tekwizard. It may not be reproduced, published or transferred in any form without our prior written permission. This does not apply to content belonging to our customers. We are not responsible for any damage to your computer caused by using this website.
Not only continually guarding us from SPAM but fraudulent emails and general web hosting security, we look forward to another 15 years of service from Tekwizard. Happy customers."
